Circular Car Hire Rental Terms and Conditions

 

Driver Information

The rented vehicle can be used only by the person/s stated on the rental agreement and the delivery form. No insurance packages will be applicable in case any damages are caused as a result of the vehicle's use by any third person/s that are not stated in the agreement. If you wish to add new drivers you can purchase an "Additional Driver” service at our offices or at the time of the booking on our website. Maximum 2 additional drivers can be defined for every vehicle. Vehicles are rented based on the age and years of license as defined for the vehicle groups. In the event that these requirements are not met, you can rent the vehicle in question by purchasing the "Young Driver Service Pack” and according to the limitations of the pack. Please contact our reservations center or offices to learn about the prices of the Additional Driver and Young Driver services.

 

Min/Max Age and Driver Licence Requirements

Details regarding the required minimum and maximum driver's age and minimum years of license for the vehicle groups are stated in the table below. The given requirements are applicable to both the renting driver and the additional driver/s.

Rental Period

Rental period is calculated over 24-hour periods. Monthly rental period is calculated over 30 days. Your rental starts from the time written on the rental contract and is calculated as 1 rental day after the 24-hour period expires. According to Circular Car Hire conditions, the period up to 24 hours from the time written on the rental contract is calculated as 1 day, no daily rental fee is charged for delays up to the first 59 minutes exceeding 24 hours. For delays exceeding 59 minutes (including daily calculated services, including navigation, additional driver, insurance, child seat, etc.) daily rental fee is charged.

One Way Rentals

If pick up and drop off locations are different, one way fee applies. It is stated at the time of the booking if the pick up and drop off locations are selected differently. Hotel and address deliveries within city limits are also possible upon request and the delivery and collection charges are 0.50EUR+TAX/km. The distance is measured from the nearest Circular Car Hire office.

Extensions

The renter is obliged to notify the extension request regarding the vehicle he has rented to the relevant office at least 1 day (24 hours) before the end of the rental. The extension can only be made with the approval of the relevant rental office.

 

Credit Card – Payment Conditions – Security Deposit (Preauthorization)

At the time of the booking online, the credit card used to make payment does not need to be in the name of the leading driver,however the renter must have a credit card in his name when she/he is present to pick up the car. VISA or MASTERCARD credit cards are needed for security deposit. (maestro, switch visa electron and debit cards are not accepted). Cash Deposit is not accepted unless the rental station takes initiative. At time of pick up you will be required to leave a deposit to cover the value of the insurance excess. Usually it takes the form of an amount (minimum: Excess+Fuel+Tax) being blocked on an international credit card in the name of the primary driver. The blocked amount will be released in full after 7-15 business days after returning the rented vehicle if the vehicle is returned in the same condition as rented. Circular Car Hire has nothing to do with refunding the blocked security deposit. It may vary according to banking procedures. Please note due to the foreign exchange rate and other possible banking charges the renter will have to take responsibility for the possible expenses involved when the deposit/excess is charged/refund. If a customer does not have a valid credit card in his/her name or if he/she does not sufficent balance on his/her credit card for security deposit, or if he/she does not meet the rental requirements stated throughout the terms and conditions, Circular Car Hire will not release the rental car. Customers must have 2 separate credit cards from 2 separate banks in order to collect our Premium and Luxury class cars,SUVs or minivans. If Circular Car Hire fails to serve the customer due to its own reasons, the full amount paid by the customer is refunded.Please find detailed information in the table below;

DAMAGE RATE TABLE

The damage definition and quantification has been done according to the following criteria:

• Car Body: damages are quantified and updated according to “Wincar”, a system commonly acknowledged by the leading insurance companies, and based on the car manufacturers rate tables;
• Crystals: damages are quantified and updated according to the price tables of the car manufacturers;
• Tyres: damages are quantified and updated according to the price tables of tyre manufacturers.

All the amounts shown below are inclusive of labor, works and accessory materials necessary for the restoration, as well as the waste disposal. They also include the technical stop, calculated on the basis of the days required to repair the car (including eventual ordering time of spare parts) calculated on the basis of the standard daily rental rate. The evaluation of mechanical damage, multiple damage and damage not detailed in this table, is done case by case by the Lessor after examining the damaged car and according to the type of damage; this evaluation also takes into account labor costs, works and accessory materials required to repair the car, as well as the waste disposal. It also includes the technical stop, calculated on the basis of the days needed to repair the car (including eventual ordering time of spare parts) calculated on the basis of the standard daily rental rate. Damages are classified according to the table below. Once the damage has been determined, according to the above criteria, the Lessor has the sole discretion to determine when to perform the repair.

NON CHARGEABLE SCRATCH

Consists in a single scratch, less than 5 cm, detected on the car body, except of roof, crystals, mirrors, lights, glasses, rims and tyres.

SLIGHT SCRATCH

Consists in a single scratch longer more than 5 cm and less than 10, or a single scratched area whose extent doesn’t exceed the surface of the rental car. (10x5 cm). A single scratched happened on the following parts of the car: roof, crystals, mirrors, lights, undercarriage, glasses, rims and tyres, even if longer less than 5 cm, is considered “slight”, so it is chargeable.

SEVERE SCRATCH

Consists in a single scratch longer than 10 cm, or a single scratched area whose extent exceeds the surface of the rental car.

SLIGHT DENT

Consists in a single dent whose extent doesn’t exceed the surface of the rental car.

SEVERE DENT

Consists in a single dent, or a group of dents, whose extent exceeds the surface of the rental car, but doesn’t exceed a unique surface sized 40x40 cm.

REPLACEMENT/BREAKAGE/MISSING PART

Consists in a damage which requires the replacement of a part of the vehicle, because missing, broken or compromised; this category includes also single or multiple dents larger than 40x40 cm.

Cancellation, No-Show and Amendments

Cancellation Policy

1 - If you cancel 48 hours prior to your pick up, you will only be charged 25 EUR as administration fee and you will be refunded the rest of the amount.

2 - If you cancel less than 48 hours in advance, you'll receive a refund minus 50 EUR for fully prepaid bookings. If your online payment is less than 50 EUR , no refund will be made for your car hire booking.

3 - All cancellations should be made on our online portal and not with the car hire agent. Should you agree to cancel directly with the car hire agent on arrival, you must also inform us of this change to your booking.

4- No refund will be made if the pick up time is within 24h time.

What is a No-Show

A 'no-show' occurs for the following reasons:

1 - You didn't inform us about your cancellation prior to your pick up date.

2 - You failed to pick up the car at the arranged time and date.

3 - You failed to provide the documentation that's required to pick up the car.

4 - You failed to provide a credit card in the main driver's name with enough available funds on it.

In the event of any of the reasons above, no refunds will be made to you.

The car hire company reserves the right to refuse a car if you fail to arrive on time with all necessary documentation and a credit card with enough available funds for the car's security deposit.

Amendment

If you need to make an amendment with your booking,you must contact us at reservation@circularcarhire.com.tr or info@circularcarhire.com.tr Our agent will take good care of you.

 

Early Return/Unused Days

No refund will be made for prepayment rentals delivered earlier than the day they should return. The request for amendments regarding the drop off date must be made via Circular Car Hire central reservation department or the relevant office before the rental begins. Amendments requests at the beginning or during the rental are invalid.

 

Driver’s and Additional Driver's Responsibilities

1. a) The vehicle is under your responsibility with its accessories and key (other keys, if any). Keep the vehicle locked whenever you are not driving, and use it if you have a safety device supplied or installed in the vehicle. You must protect the vehicle against bad weather conditions that can cause damage. Make sure you use the correct and suitable fuel. Check the oil and engine temperature levels and keep the tire pressure in the required optimum
2. b) It is your responsibility to drive safely, following the road conditions and speed limits.
3. c) As long as the rental contract continues, you must drive the rental car as the "owner" of the vehicle in accordance with the Highway Traffic Law No. 2918 and Traffic No 26901 dated 13.10.1983. You are responsible for any crime, parking ticket, traffic fines that may arise later. In addition, if requested from you, you are obliged to provide all requested information about you and the additional driver with you. If you fail to provide us with this information completely, you accept in advance all responsibility. Due to the obligations described in this paragraph, the rental agreement will remain in effect until the vehicle is returned to us. All of our vehicles in our fleet have HGS stickers. When your rental period expires, your HGS usage information will reach our offices and the toll will be charged on your credit card. Since the collection process related to the toll is dependent on the General Directorate of Highways, it is possible to collect later than usual periods. In case you pass through OGS tolls with our HGS equipped vehicles; it will be a forbidden pass so you will have to pay for it. The illegal toll (as in other traffic violations) is paid to the relevant government institutions by Circular Car Hire and the illegal toll (as in other traffic violations) is charged on the credit card supplied on pick up.
4. d) You are responsible for all damages that will occur as a result of the driving of the vehicle in mountainous terrain, swamps and beaches, and the damage caused by water entering the engine or other parts of the vehicle due to its drivingin such None of our cars including 4X4 SUVs cannot be driven off road and the renter accepts in advance that he/she will always drive it on suitable roads.
5. e) You may not sell, rent or dispose of the vehicle and any parts. You cannot grant anybody authorization on the vehicle and you cannot transfer your own rights. For safety reasons, under no circumstances should you complete the brake, clutch, transmission oils, or engine coolant fluid levels. In case of any warning light on the instrument panel or low oil levels, please contact us immediately.
6. f) You should not allow anyone to work on the vehicle without any written permission. If we give you approval, we will pay related expenses to you on your return if you submit invoice.
7. g) If you find any disruption about the vehicle, you should immediately warn us.
8. h) Due to the changes made in the vehicle without our approval, the expenses we will pay to return it to its pre-rental status (for example, for extra repair time or the necessary materials and tools) or if the interior of the vehicle is damaged, it will be connected to the vehicle or if it is inside the vehicle, renter is responsible for the damage caused by the misuse or negligence..

 

Personal Belongings

At the end of the rental, check if you have any personal belongings in the vehicle. Circular Car Hire takes no responsibilities for any item you have forgotten in the rental car.

Requirements for Driving the Vehicle

Conditions that the leading or other additional drivers stated on the contract must comply with are as follows:

• You must not drive the vehicle to race, to speed up, to test the vehicle's endurance and speed, and to teach someone else to drive.
• You must not drive the vehicle when and after you drink alcohol or you under the influence of drugs.
• Border Crossing is not permitted!
• You must not carry more than the specified passenger capacity of the vehicle.
• You and other drivers stated on the contract cannot use the rental car for pushing or towing other vehicles or materials that move or do not move unless we give you our written consent.
• You can not use it for the transportation of passengers or goods in exchange for an explicit or hidden income.
• You cannot not use it for the transportation of substances that are against customs regulations and other laws, and for other illegal activities.
• If the renter carries any animals that damage the vehicle due to its smell or condition, or cause Circular Car Hire to waste time or money to rent the car again, she/he will be charged for loss of revenue and the customer accepts in advance that she/he will not dispute to it.
• The renter cannot travel off roads, on roads that may damage to the vehicle's wheels, tires undercarriage of the rental car.

 

Fuel Policy

Full-tank is not a must. Renter returns the tank with the pick-up level. If the vehicle is returned with less fuel than when picked-up, a service charge of 40% will be calculated on top of the missing fuel.No refunds for unused fuel are given. 

Vehicles 

Vehicles displayed on our website or on broker websites that provide us with bookings are all samples and we cannot guarantee a specific make and model. We can serve with another car in the same group or we can upgrade your car without any prior notice if needed.

Miscellaneous Charges and Fees

Fees to be paid are as follows;

1. Rental and other charges specified and stated in this vehicle delivery form or the rental agreement.
2. The sum of the fees, losses, damages, expenditures, costs or liabilities arising from non-compliance with the rules stated in the " Driver’s and Additional Driver's Responsibilities" section in the article.
3. Refueling service fee; If you do not return the fuel to the level we gave you at the beginning of the rental, the fuel fee will be collected from the amount indicated on the Vehicle Delivery Voucher or the amount stated in the brochures printed on the counter at the place of your rental or by adding a 100.00 TL + 18% service fee to the existing pump sales prices.
4. Any penalties or fees charged by an institution.
5. Traffic fines or the costs that may arise are charged on your card together with and administration service fee of 30.00TL + 18% VAT.
6. During your rental period, your use of HGS will be charged with a service fee of 25.00TL and plus 18% VAT after the end of the rental.
7. Irrespective of the insurance package the customer takes out, she/he is charged for transportation or administration charges that may incur such as reaching out to a police station outside city to obtain reports.
8. Winter tyre can be booked and requested. It is 50.00TL + 18% per day and 500.00TL + 18% in total.
9. Damage repair costs, which are not specified in the Vehicle Status Report or Rental Agreement at the time of check in of the rental car, regardless of whether you are at fault or not, and the fees to be incurred in accordance with the insurance packages specified in the beginning of the rental.

 Insurance

Our rates include Third Party Liability,Collision Damage Waiver with excess,Theft Protection with excess. In case of theft, it is mandatory that you immediately inform the car rental company, file a police report and then give a copy of this document to the car rental company. Car documents and keys must be handed to the nearest office. Any unnoticed accident or damage to the vehicle may be interpreted as negligence and the insurance becomes void, therefore this may result in a charge to the renter. If the renter has not taken out tyres windscreen and headlights waiver (TWH) at the time of pick up or booking, she/he is charged for any damages to those parties. Undercarrige of the vehicle is never covered by insurance and any damage to the underbody of the rental car is charged directly on the customer and she/he accepts in advance that she/he will not dispute to it.

The renter agrees in advance that she/he will cover all expenses that may arise as a result of abuses such as driving the vehicle negligently and carelessly, filling faulty/wrong fuel.

The renter shall pay in any way in the event of a person not registered on the rental agreement driving the vehicle, carrying more passengers than the capacity of the vehicle, driving under the influence of alcohol or drugs, and an accident caused by the stated reasons.

 

Minor Damage Insurance (MDI)

It covers scratches up to 7.5cm on the vehicle, dents up to 2.5cm, scratches up to 4cm on the rim and stone damage up to 5mm on the glass. Damages up to 500 TL (parking lot, minor scratches, etc.) occurring without the collision are covered by the customer statement without the need for a police report.

 

Tyre Windscreen and Headlights Waiver (TWH)

It protects you from any charges in case of any tyre puncture,cracks on the windscreen or on the headlights.

 

Super Excess Cover Waiver (SECW)

The renter must pay the first part of the claim in case of a damage or collision. Excess fee varies btw 300 EUR and 3000 EUR depending on the vehicle group. If the customer wishes, he / she also takes out this optional insurance and eliminates the excess fee and does not take any responsibility in the event of any damage to the car. (Submitting alcohol and police reports are mandatory.) Excess fee is charged according to the vehicle group delivered to the customer. Our Damage Insurance Packages

You can find detailed information regarding our insurance packaged in this section. Descriptions are for general and informational purposes. Circular Car Hire reserves the right to change this information or insurance package coverages in due course. Your voucher includes the optional insurances you take out at the time of the booking. You can also purchase additional insurances on pick up so you can eliminate the risk of damage charges which may incur.

 

1. a)  We have a legal obligation regarding mandatory insurance against third parties. In the event of an accident, if you injure, or cause someone to die or materially damage a person, the officially stated traffic insurance limits apply (the limits covered by the Traffic insurance for property losses).

 

1. b) If you have purchased the Premium package including Super Excess Cover Waiver / Theft Protection Waiver and Tyre Windscreen and Headlighes Waiver, the damage is under our guarantee. If you have not taken out Premium insurance,you will be charged according to the insurance packages you have selected or deselected.

 

1. c)  If you purchase the TWH protection package, you will not be held responsible for paying for flat/wrecked tyre,crack on the windscreen or on the headlights.

 

Conditions Outside the Scope of Damage Insurance

 

• Any accident involving the person who drives the car exceeding the legal limit under the influence of alcohol or drugs

• Damage to the underbody of the car
• Burning of car seat upholstery, spilling liquid, delivering extremely dirty
• The use of the car in mountain terrain, sand, swamp, beach etc. Damages caused by the use of cars on roads that are not suitable for traffic, the use of places, roads and roads that are contrary to the strength and properties of cars, rally, speed trials, driving in motor sports and in areas closed to traffic.

• Stolen of your personal belongings from the car, theft of the vehicle key, dropping into the water, license, license plate and / or tool, wheel cover and spare wheel losses, losses and losses of additional equipments rented.
• Accidents or damage involving the driver who is not registered in the rental agreement.
• Damage caused by natural disasters.
• Damages caused by transporting cage-free animals in the car.

• Force majeure

IN MULTI-VEHICLE ACCIDENTS OR SINGLE VEHICLE ACCIDENTS, THE RENTER MUST OBTAIN AN OFFICIAL ACCIDENT REPORT AND ALCOHOL REPORT FROM THE POLICE OR GENDARME. IN THE EVENT OF FAILURE TO SUBMIT THE RELATED REPORTS, THE RENTER IS FULLY RESPONSIBLE FOR THE DAMAGES OCCURED.

Very Important Notes

What must be done in in the event of an accident/damage.

• You must obtain an accident report in accordance with the shape of the accident without moving the car/cars and contact the nearest police or gendarmerie station, take alcohol detection reports immediately and report it to our office where you have collected the vehicle from. It is mandatory you contact us on the mobile phone number which you have been given at the time of pick up. It is your prior responsibility to report any damage when you are in accident scene.
• In the event that the vehicle is stolen, immediately and not later than 24 hours, you must contact the nearest police or gendarmerie station and report it to our Full Support Line at +90 444 18 54 and also contact us on the mobile phone number which you have been given at the time of pick up. Otherwise, all insurance packages purchased will be deemed invalid and all damages incurred will be charged from the renter, including the material and moral losses given to third parties.
• In case of any breakdown of the rental car, you must contact the office you picked up the car from.
• Please make sure that the vehicle check out and check in form is filled in and signed mutually at check out and check in of the vehicle.
• In the event that you have a one sided (single vehicle accident), the accident and alcohol detection reports must be obtained by applying to the nearest police or gendarmerie station without moving the car from the accident scene.
• In multi vehicle accidents, except for the cases stated in the following articles, drivers are obliged to fill in the Material Damage Accident Detection Document as indicated on the report, depending on the type of accident.

In multi vehicle accidents, the traffic accident report is issued by the traffic police only in the following cases;

• If the driver is suspected of mental health and alcoholism,
• If the other party is driving a motor vehicle without a license,
• If one of the vehicles involved in the accident has an official (state,embassy,legal organization, municipal bus,any kind of government agency) plate,
• If any kind of damage has occurred in public property,
• If a third party’s personal belongings are damaged,
• If one of the vehicles involved in the accident does not have Mandatory Traffic Insurance Policy,
• If the driver is under age,
• If the traffic accident resulted in death or injury,
• If you cannot agree or you have conflict with the other driver(s) in the event of an accident,

Further Responsibilities of the Renter in the event of an accident;

• To obtain a photocopy or legible visual of the driver's license, license and traffic insurance policies of the party / parties in multi vehicle accidents.
• To take pictures of the accident scene from several aspects and make sure the plate numbers of the vehicles involving in the accident are all visible enough.
• Do not leave the vehicle without taking adequate and proper security measures,
